Article 1 — Identification of the parties
This contract is entered into between Gignac Canoë Kayak, a non-profit association under the French law of 1901 operating a canoe, kayak and paddleboard rental base on the Hérault river in Gignac (hereinafter "the lessor"), and any person of legal age making a rental or a booking (hereinafter "the renter").
The renter commits both on their own behalf and on behalf of all the people for whom they have booked equipment. They undertake to inform those people of the content of these terms and conditions of sale.
The renter must be of legal age. Rental by a minor who is not accompanied by a responsible adult is prohibited.
Article 2 — Prerequisites for rental
2.1 Physical fitness and swimming ability
Paddling on the Hérault requires being able to swim at least 25 metres and to submerge, for children over 6 years old and for adults. The renter declares on their honour that they meet this requirement, both for themselves and for the people in their charge.
All children under 10 years old require the permanent presence of a parent or legal guardian on board the same craft, and must wear a suitable life jacket provided by the lessor.
2.2 Liability and insurance
In accordance with the federal rule "one participant = one licence", the lessor takes out a one-day FFCK licence for each participant, a necessary condition for the insurance cover to apply. This licence includes public liability cover for damage caused to others, as well as basic personal injury cover.
The renter remains entirely responsible for the people for whom they have booked equipment, in particular any minors placed in their care.
2.3 Protection of personal data
In accordance with the French Data Protection Act and the GDPR, the data collected when booking is used exclusively for the management of rentals. You have a right of access, rectification and objection, which you may exercise by contacting gignac.canoekayak@gmail.com.
Article 3 — Equipment provided
Depending on the option chosen, the lessor provides the renter with:
- Craft: canoe (single, double or triple) or paddleboard, subject to availability and to the route chosen
- Personal flotation equipment: buoyancy aid for every participant, life jacket for children aged 3 to 6
- Paddling equipment: paddles and a waterproof barrel
All equipment is serviced and inspected regularly. The renter takes possession of the equipment in good condition and is responsible for its safekeeping throughout the rental period.
Wearing the buoyancy aid is compulsory for the entire duration of the trip, closed and adjusted to the body.
The lessor cannot guarantee that the barrel is watertight — this depends on how the user closes it.
Article 4 — Routes offered
Three routes are available for rental; their characteristics are described on canoe-diable.com:

In the event of unfavourable weather or water conditions (flood, extreme drought, orange or red weather warning), the lessor may cancel or modify the routes. In that case, any sums paid are refunded in full.
Article 5 — The renter's obligations
5.1 Conduct on the water
- Wear the buoyancy aid at all times, closed and adjusted
- Do not leave any equipment behind along the route
- Do not leave any litter on the banks or in the water
- Respect the banks, the wildlife, the plant life and the other users of the river
- Respect the Natura 2000 area: do not pick plants, do not disturb animals
- Be back at the base before 6 pm
5.2 Responsibility for the equipment
The renter is responsible for the equipment from the moment they take charge of it. Any equipment lost, abandoned or damaged through negligence will be charged at its replacement value. The lessor cannot be held responsible for the personal belongings taken along by the renter.
5.3 Animals
Dogs are accepted on the Detente route only, entirely at their owner's responsibility. No buoyancy aid for animals is provided — bringing one is recommended. The dog must remain under its owner's control for the entire duration of the trip.
Article 6 — Prices and payment
The prices in force are displayed on canoe-diable.com and at the nautical base. They include the paddling equipment, the personal flotation equipment and, depending on the route, the shuttle.
Payment is made in full before taking possession of the equipment. No deposit is required when booking.
Accepted means of payment: bank card, cash, cheques, ANCV holiday vouchers.
Article 7 — Bookings and cancellations
7.1 Booking
Booking is compulsory for The Pont du Diable Descent and The Gignac Crossing, because of the shuttle coordination involved. It is not required for The Detente, subject to the availability of craft.
7.2 Cancellation by the renter
As no deposit is required, cancelling incurs no charge. The renter is asked to inform the lessor as soon as possible so that the slot can be freed up for other customers.
7.3 Cancellation by the lessor
Should the lessor cancel for weather or water-level reasons (orange or red warning, flood), the renter is informed as soon as possible. As no payment is taken in advance, no refund is due.
Article 8 — Times and delays
For routes with a shuttle, the times given when booking are binding. In the event of a delay that has not been reported, the lessor reserves the right to cancel the service.
For every route, the equipment must be returned before 6 pm.
Article 9 — Loss or abandonment of equipment
Any equipment that is not returned, that is lost or that is abandoned along the route will be charged to the renter at its replacement value as new, in addition to the cost of the rental. Any costs incurred in recovering the equipment will also be charged.
